This was a jury verdict against the City of New York and the New York City Police Department for failure to protect a child from a fire bomb assault. While the child was asleep, a bottle with an accelerant was thrown through the bedroom window igniting the child's bed. The police department had prior knowledge of an ongoing dispute between the child's mother and a coworker but failed to protect the child and his mother despite assurances to that effect. The child sustained significant facial damage as a result of third-degree burns. Our injury attorneys tried the case in Bronx County Court and obtained a $10,000,000 million verdict for the child and his mother.

The plaintiff in this psychological malpractice case had received therapy from a psychoanalyst over a number of years. During this time the psychoanalyst violated patient confidentiality and entered into a sexual relationship with the girlfriend of his patient. The patient was caused significant emotional injury due to the doctor's breach of trust and required additional psychiatric care. The case concluded with our attorneys securing $4,200,000 for the patient and the doctor being suspended from the practice of psychology for two years.

This was a jury verdict in a construction accident case involving the building of a high-rise condominium in Manhattan. The plaintiff, a laborer, was struck by a piece of lumber as it fell from an elevated height during the construction of the building. Each of the four defendants in the lawsuit blamed each other; however, the jury found the general contractor 90 percent responsible and two of the three subcontractors 10 percent responsible for the accident. The plaintiff sustained herniated discs in his lower back and neck, which resulted in the need for spinal fusion surgery. Our firm recovered $3,500,000 for the plaintiff on behalf of his injuries.

United States District Court for the Southern District of New York

This is one of five wrongful death recoveries our firm obtained as a result of the American Airlines crash in Belle Harbor, New York the week after September 11, 2001. The crash took place when an American Airlines flight bound for the Dominican Republic encountered substantial turbulence taking off from John F. Kennedy International Airport. Both American Airlines and the French manufacturer of the Airbus were sued. The two entities contributed to this settlement as well as to the settlements of the four other cases brought by Weiser & Associates.

This was a product liability case brought against four defendants for causing the death of a volunteer firefighter who was filling a fresh air pack at the firehouse to be used by firefighters when entering a smoky building. The canister, which was being filled under high pressure exploded, causing a piece of metal to pierce the firefighter’s chest and sever his aorta. The jury found two hydro testers, who approved the structural integrity of the canister, to be primarily responsible for the accident. The firefighter’s family recovered a sum of money for his wrongful death and conscious pain and suffering.

This was a settlement reached on the eve of a premises liability trial involving a lead paint injury. Before trial, our attorneys made a motion for summary judgment as to liability. The Supreme Court, New York County, granted this motion, holding that the landlord failed to abate a peeling lead paint nuisance, which exposed a young child to serious harm when she ingested paint chips in her apartment. As a result of the exposure, the child suffered physical and emotional injuries and was found to be at high risk for future learning disabilities. After the Court found the defendant liable for the injuries sustained by our client, the insurance company for the negligent landlord, facing an immediate jury trial as to damages, decided to avoid the case and make a substantial settlement offer. In addition to receiving a large up-front payment, the infant plaintiff was guaranteed large regular payments over a period of approximately 15 years, for a total of approximately $1,400,000.

During the course of a bunionectomy, a podiatrist broke off a piece of metal bur in the plaintiff's foot. The podiatrist failed to inform the plaintiff of this mishap, allowing her instead to suffer for two years before another podiatrist found the piece of metal in her foot through an x-ray. Despite the defendant's testimony of advising the plaintiff that the bur had broken, the jury found that the plaintiff was not informed and suffered needless pain and additional surgery due to the doctor's coverup. Our injury attorneys obtained this jury verdict in New York County against STARBUCKS Coffee Company. The plaintiff in the case was burned by hot coffee that was spilled on her by a STARBUCKS employee, causing second degree burns to her foot. STARBUCKS denied fault for the incident, offering to settle the case for the cost of the medical bills only, which totaled under $1,000. A jury of six found STARBUCKS 100 percent at fault and awarded our client $300,000 in damages.
